Performed an evaluation of air discharges and industrial activities to satisfy an inquiry by the NYSDEC.

BALL CORPORATION, Middletown, New York
Performed an emissions mass balance evaluation and calculation including volumetric flow rate measurements at all emission points for Title V permitting.

BEECHER POTTERY, Town of Jewett, New York
Inspected and reviewed the operating parameters of an artist’s kiln and prepared a briefing letter to obtain local approvals.

J&J LOG AND LUMBER CORPORATION, Dover Plains, New York
Obtained an Article 19 Air State Facility Permit for a wood boiler and a diesel electric generator.

Indoor Air Quality Sampling and Mitigation

APPLE VALLEY SHOPPING PLAZA, Poughkeepsie, New York
Sampled and assessed soil vapor impacts.  Designed a Soil Vapor Mitigation Plan and a HASP for use during site improvements.

BUSINESS OFFICES, Albany, New York
Conducted mycological sampling in various business offices.  Air samples were collected using an Aerotech 6TM Viable Microbial Particle Sampler and an Air-O-Cell™.  Surface samples were collected using a swab.  Data was analyzed and a report with recommendations was completed.  Monitoring post-remediation was also produced.

ELMIRA CITY SCHOOL DISTRICT, Elmira, New York
Conducted soil sampling in the area of a planned addition.  Prepared Soil Vapor Mitigation Design (SVMD) Plan, Soil Management Plan (SMP), Indoor Air Quality Action Plan (IAQAP), Health and Safety Plan (HASP) and Community Air Monitoring Plan (CAMP) in support of bidding for construction of addition and proper management of existing building and grounds.

Designed and inspected installation of sub-slab depressurization systems for new addition to high school and renovated gymnasium.  Collect sub-slab vapor and indoor air samples on an annual basis as required by the NYSDOH.

RESIDENCE, Rotterdam, New York
Pesticide sampling was conducted at a residential building to determine the extent of pesticide misapplication.  Interpreted sampling results and modified the remedial effort in the Health & Safety Plan and interior air monitoring plan.  Interpretation of air monitoring during and post-remediation was provided.

Landfill Gas Monitoring

6 NYCRR 360 Post-Closure Gas Monitoring – Conduct sub-surface explosive gas surveys at landfill perimeters and onsite structures to document if gases are migrating off landfill properties.

CLINTON COUNTY, Plattsburgh, New York
STERLING conducted and/or supervised baseline environmental studies, prepared a Draft Environmental Impact Statement (DEIS) and prepared the Long Term Development Plan associated with a major expansion of the Clinton County Landfill near Plattsburgh, New York.  The DEIS carefully evaluated the existing environmental condition of the facility and its environs and assessed the potential environmental impacts to surface water, groundwater, visual resources and community character.  Pre-expansion baseline conditions were defined for noise, dust, traffic and future impacts were modeled using industry-accepted methodology.  STERLING conducted or supervised all supplemental field activities, data collection and reporting, and was fully responsible for the production of the DEIS document (a document that measures 15” in thickness).

STERLING’s work product also served as the primary submittal to the Federal Energy Regulatory Commission (FERC) for related environmental approvals needed for the land transfer necessary for the landfill expansion project.

This multi-year role by STERLING was integral to New England Waste Services (NEWSNY’s) and Clinton County’s receipt of a permit from the NYSDEC and approvals from FERC for the initial phase of the project.  The SEQRA compliance efforts by STERLING and the project team satisfied the additional permitting needs for the next 50 years.

COOPERSTOWN GEIS, Cooperstown, New York
Researched and prepared portions of the GEIS concerning water and wastewater infrastructure, including lake capacity, soil limitations and water and wastewater treatment facilities characteristics, capabilities and limitations.

SPRINGFIELD(Glimmerglass Opera), Springfield, New York
Representing the Town Planning Board, reviewed a proposal by an organization planning to expand its living facilities and associated wastewater treatment facilities.  Issues were raised regarding wetlands, soils permeability, adequacy of former treatment facilities, and special requirements for the Otsego Lake drainage basin.

ST. LAWRENCE CEMENT, Hudson, New York (client: Columbia Hudson Partnership)
Reviewed air permit applications and an Environmental Impact Statement for deficiencies, especially with regards to issues that could affect local business and commercial development.  Participated in issues conference and negotiation of a memorandum of agreement

TAYLOR BIOMASS ENERGY, LLC, Montgomery, New York
Prepared a DEIS and FEIS to address the construction of the Taylor Biomass Energy, LLC Gasification project including sections on traffic and transportation, visual resources, cultural resources, noise, air quality, zoning and other plans, community facilities, infrastructure, ecology, water resources, environmental justice and construction.

Researched and prepared portions of a Comprehensive Plan for the Town of Pine Plains including a solid waste, water and wastewater infrastructure evaluation and needs assessment.  The Comprehensive Plan also included a summary of soil limitations, drinking water well survey, groundwater quality and yield information, water and wastewater treatment facilities capabilities and limitations, watershed protection issues, and identification of potential funding sources to address future needs.

TOWN OF WINDHAM GEIS, Windham, New York
Researched and prepared the GEIS concerning stormwater turbidity, stormwater management, water and wastewater infrastructure, septic systems, soil limitations, utilities, cellular phone coverage, wireless internet coverage, public transportation, traffic constrictions and publicly owned land.

VILLAGE OF ATHENS, Athens, New York
Provided an analysis of visual, noise and stormwater impacts of an application to build a new asphalt facility.

Phase I ESAs:

STERLING performs environmental site assessments (ESAs) using American Society for Testing and Materials (ASTM) Standard E1527 for All Appropriate Inquiry (AAI), the industry standard for performance of environmental due diligence typically required by lenders and regulatory agencies.  Phase I ESAs are typically conducted to evaluate the potential for release of hazardous substances or petroleum products, and to identify “recognized environmental conditions.”

A Phase I ESA under this method consists of:

  • Reviewing governmental records (tax maps, building permits, zoning approvals) and databases (environmental permits, spill reports, remedial actions)
  • Reviewing available literature (prior reports, permit records), aerial photographs and available mapping (e.g., topographic and fire insurance maps)
  • Interviews with government officials and other parties knowledgeable of the property and its history (current and past owners/occupants)
  • Conducting site inspection (including building interior, exterior, and observations of adjacent properties)
  • Report preparation

STERLING performs Phase I ESAs for a wide variety of clients, such as parties conducting pre-acquisition due diligence on multiple properties, individuals and small companies interested in buying a property, attorneys assisting clients, small and large companies wanting to assess their own property before initiating the sales process, and developers needing to control risk prior to a major investment.  STERLING is experienced in transitioning from the Phase I ESA process to subsequent steps while assisting clients in their specific needs.

Phase II ESAs:

Phase II ESAs generally consist of a more extensive investigation into identified environmental conditions.  The objective of a Phase II ESA is to evaluate the environmental condition in order to provide sufficient information regarding the nature and extent of contamination to allow informed business decisions.

A Phase II ESA may include:

  • Environmental sampling (soil, groundwater, surface water, soil vapor)
  • Geophysical surveys (radar, magnetometer)
  • Test pits and/or trenches
  • Dye tracing

STERLING has designed and completed Phase II investigations on many properties with a wide range of histories including locations of former or active:

  • Spills of petroleum, hazardous chemicals or pesticides;
  • Petroleum or chemical tanks;
  • Fuel stations;
  • Factories;
  • Dry cleaners;
  • Container storage areas;
  • Floor drains;
  • Landfills;
  • Pesticide storage or application;
  • Solid waste storage; and
  • Waste collection floor sumps.

STERLING has been involved in negotiations between buyers and sellers regarding cleanups where environmental conditions have been identified.

Phase III ESAs:

Phase III efforts involve remediation or mitigation of sites impacted by petroleum or hazardous substances.  STERLING has utilized its expertise to design and gain NYSDEC approval for remedial or mitigating work plans, to obtain competent contractors, to supervise the work effort and conduct and report upon the confirmatory sampling.

BARNES LANDFILL
Conducted independent evaluations of the Barnes Landfill and provided a detailed deposition regarding the landfill closure costs, as well as professional opinion regarding the adequacy of the closure landfill (Industrial Recycling Services, Inc. vs.  Ahneman Associates, P.C.).

CITY OF KINGSTON, New York
Served as an expert witness representing the City of Kingston, New York in litigation concerning contract disputes involving the City landfill.

Provided an affidavit, in opposition to Defendants’ Motion for an Injunction, to demonstrate that Defendants can utilize existing curb cuts for alternate driveway configuration avoiding the need to cross Plaintiff’s land.  Provided expert report and graphics in support.

ST. VOLODYMYR UKRANIAN CHURCH, Utica, New York
Provided litigation support and expert testimony concerning oil spill adjacent to a church.  Installed monitoring wells in support of litigation effort, and conducted quarterly sampling to determine levels of contamination migrating onto church property.

STERLING performed environmental due diligence of 14 properties in update New York, which were the subject of Casella’s acquisitions of Waste Stream, Inc.  STERLING performed environmental due diligence for permitted solid waste management facilities which were the subject of acquisition by Casella Waste Management.

Utilized GIS to analyze and map wetland boundaries, vegetation communities, and other wildlife and natural resource features as part of an Ecological Assessment for a proposed waste transfer station & recycling facility. HILLS HOLDING CORPORATION C&D LANDFILL, Fallsburg, New York
A Remedial Investigation (RI) was conducted at the Hills Holding Corporation Construction and Demolition (C&D) Debris Landfill by STERLING from February to April 2007.  The site abuts the Town’s drinking water supply wellfield.  The purpose of the RI was to characterize the Landfill waste, identify the physical extent of the waste mass boundary, and determine the nature and extent of contamination at and in the vicinity of the site.  In addition, the information presented in the RI was also used to assess the need for remedial action(s). This site is an Environmental Restoration Project (ERP) funded under the ERP of the New York State Clean Water/Clean Air Bond Act.

An Alternatives Analysis was completed by STERLING and the selected remedy was presented to the NYSDEC.  The proposed remedy included excavation and off site beneficial reuse of all Landfill waste and contaminated soil, which will prevent continued leaching of contaminants to groundwater.

PALISADES CENTER MALL, Nyack, New York
Environmental permitting and impact analysis, design and construction oversight for a large mall development project.  Included landfill closure, petroleum spill remediation, installation of a leachate collection system, environmental monitoring, research leachate production rates and mitigation of leachate discharge to sanitary sewer.

STERLING was retained by the Town of Clarkstown to remediate a $6,000,000 construction claim associated with the closure of the Clarkstown Landfill.  STERLING conducted monitoring well sampling and explosive gas surveys, analyzed the results and submitted a progress report to the NYSDEC on a quarterly basis.

TOWN OF FALLSBURG LANDFILL, South Fallsburg, New York
Landfill Closure Plan, cover system design, plans and specifications for the Town landfill.  STERLING developed an application resulting in the Town receiving a SRF Low Interest Loan for the Landfill Closure.  STERLING currently conducts monitoring well sampling and explosive gas surveys, analyzes the results and submits a progress report to the NYSDEC on an annual basis.

STERLING updated a pre-closure site investigation and developed a landfill closure plan and design.

TOWN OF MONTGOMERY, Montgomery, New York
Landfill cover installation, construction certification, EQBA Grant Application and Payment Request.  STERLING successfully obtained design variances from the NYSDEC eliminating the gas vent layer of the final cover while also obtaining a $550,000 grant reimbursement from the NYSDEC.  STERLING currently conducts monitoring well sampling and explosive gas surveys, analyzes the results and submits a progress report to the NYSDEC on an annual basis

Landfill Closure Plan, cover system design, plans and specifications, construction supervision and post-closure monitoring.  STERLING obtained NYSDEC approval for Mandate Relief Variances allowing deletion of the gas vent layer and one-half the thickness of the barrier protection layer of the final cover.  STERLING also secured approval for placement of more than 20,000 cubic yards of demolition debris for rough grading purposes.  These approvals reduced the actual closure cost by more than 50% of the original estimate.  STERLING currently conducts monitoring well sampling and explosive gas surveys, analyzes the results and submits a progress report to the NYSDEC on an annual basis.  Additionally, STERLING developed Environmental Quality Review Act (EQBA) Grant Applications as well as assisted the Town in securing a State Revolving Fund (SRF) Low Interest Loan for the landfill closure.

Sterling’s commitment to Renewable Energy is evidenced by the 1,100 square foot rooftop photo-voltaic (PV solar) electric system installed in 2011.  The system consists of three Sunny Boy 5000 US inverters employing 84 Schüco MPE 180 MS 05 modular panels. The system has an installed capacity of 15.12 kWs connected to the electric grid.  The system provides for the following:

  • The average monthly PV solar electric generation is 1,390 kWhrs.
  • The building averages 3,316 kWhrs of monthly electric usage.  The PV solar panels provide 42% of the average monthly electric power needs. 
  • In its first full year of service, the PV solar electric system generated 16,776 kWhrs of electricity, which for the NYISO Grid mix results in the avoidance of approximately 12,000 tons of CO2 based carbon emissions. 
  • To date, the PV solar system is running at approximately a 13% capacity factor. Photovoltaic power capacity is measured as max power output under standardized test conditions.  The actual power output for any given PV solar system is typically below 25% and is dependent on geographic location, weather conditions and other conditions

Conducted a Focused Remedial Investigation and Feasibility Study of the former Circle M Wood Treating Site located in Fishkill, New York under the Brownfield Cleanup Program.  Performed supplemental investigations and completed a Remedial Design & Engineering Report, which set forth the engineering design for the chosen remedy.  The remedy consists of excavation and consolidation of contaminated soil, and will be conducted in accordance with redevelopment plans for the site.  The Remedial Design & Engineering Report includes a Storm Water Pollution Prevention Plan, Health and Safety Plan, Community Air Monitoring Plan, Dust Control Plan, and Site Management Plan.

CONSOLIDATED IRON, Newburgh, New York
Assisted environmental/municipal legal counsel and City Manager with review and comment on USEPA Feasibility Study, preferred alternative and draft Record of Decision.  Assisted in negotiations with multiple Potentially Responsible Parties (PRPs) working towards consensus.  Assisted in negotiations with USEPA Region 2 on alternative comparison and an apportionment of responsibility for financial contribution from PRPs.  Participated in public participation by making presentations at public meetings and hearings, as well as responding to questions from the public.  Participated in advising development team on transitioning from post-cleanup to development of site, including technical considerations, interfacing with surrounding land use and maintenance of post-closure care and deed restrictions.

SOUTH TROY PILOT BROWNFIELDS ASSESSMENT, South Troy, New York
A United States Environmental Protection Agency (USEPA) funded Environmental Assessment for the City of Troy of 56 parcels along the Hudson River as part of a comprehensive brownfields effort involving public and community outreach and participation.  Involved a team including River Street Planning and Development and Transportation Concepts.  Led to further USEPA funding of a Phase II Environmental Assessment of these parcels, including field sampling and analysis.

HILLS HOLDING CORPORATION C&D LANDFILL, Fallsburg, New York
A Remedial Investigation (RI) was conducted at the Hills Holding Corporation Construction and Demolition (C&D) Debris Landfill (Landfill) by STERLING from February to April 2007.  The site abuts the Town’s drinking water supply wellfield.  The purpose of the RI was to characterize the Landfill waste, identify the physical extent of the waste mass boundary, and determine the nature and extent of contamination at and in the vicinity of the site.  In addition, the information presented in the RI was also used to assess the need for remedial action(s). This site is an Environmental Restoration Project (ERP) that was funded under the ERP of the New York State Clean Water/Clean Air Bond Act.

Former M. Argueso and Company, Inc., Mamaroneck, NY
Conducted groundwater monitoring and confirmatory soil sampling for tank excavations as part of a Brownfields Cleanup Program investigation.  Sampling methods followed NYSDEC DER-10 / Technical Guidance for Site Investigation and Remediation.  Implemented an Excavation Work Plan, Citizens Participation Plan, CAMP and HASP for the project.  STERLING conducted the CAMP during excavating and truck loading activities, following guidelines provided in the NYSDOH Generic Community Air Monitoring Plan.  STERLING ensured compliance with the HASP by monitoring workers’ breathing space air quality.

Performed a Phase I Environmental Site Assessment at a former oil storage facility.  Negotiated with former owner and NYSDEC regarding cleanup requirements and development options and limitations.  Oversaw performance of investigations and remedial work.

Assessed liquid containment measures and spill response policies for a truck staging area managing liquid hazardous waste and petroleum waste, and sampled accumulated stormwater. Designed wastewater treatment facility and applied for wastewater modification to the State   Pollutant Discharge Elimination System (SPDES) permit.  Modified process wastewater and cooling water facility design and obtained modified SPDES permit.

PINE PLAINS, Pine Plains, New York
Researched and prepared portions of a Comprehensive Plan for the Town of Pine Plains including a solid waste, water and wastewater infrastructure evaluation and needs assessment.  The Comprehensive Plan also included a summary of soil limitations, drinking water well survey, groundwater quality and yield information, water and wastewater treatment facilities capabilities and limitations, watershed protection issues, and identification of potential funding sources to address future needs.

Represented the Town Planning Board, reviewed a proposal by an organization planning to expand its living facilities and associated wastewater treatment facilities.  Issues were raised regarding wetlands, soils permeability, adequacy of former treatment facilities, and special requirements for the Otsego Lake drainage basin.

Project Highlights

Saratoga Biochar Solutions is proposing to construct and operate a facility that manufactures carbon fertilizer ("biochar") through drying and pyrolysis of biosolids and wood waste. The facility is proposed for the Moreau Industrial Park in Saratoga County, NY, and has received local approval and a Notice of Complete Application from the NYSDEC.


The Montgomery Project uses the proprietary "Taylor Energy Solution" as the foundational technology for a three-part, integrated system design that converts the organic biomass portion of mixed solid waste to electric power, through gasification.
